Terms of use

The rules for using Formset. Short, and written so you can actually read them before you agree.

1. The agreement

These terms are a contract between you and [COMPANY LEGAL NAME], which operates Formset at getformset.com. By signing in, connecting Formset to an assistant, or publishing a form, you agree to them. If you are agreeing on behalf of a company, you confirm you may bind it.

Our privacy policy explains what we do with personal information and forms part of this agreement.

2. What Formset does

Formset creates and hosts web forms on your instruction, collects the answers, and returns them to you. You reach it through an AI assistant that connects to our service; the assistant is not ours, and how it behaves is between you and whoever makes it.

Formset does not send your forms or answers to a language model. If your assistant shows you your answers, it is because you asked it to fetch them.

3. Your account

You sign in with Google, and there is no separate password. Keep your Google account secure, because anyone who controls it controls your Formset data. You must be at least 16 years old and legally able to enter this agreement.

You are responsible for everything done through your account, including by anyone you let use your assistant.

4. Your forms and the answers you collect

Your forms and the answers people send you are yours. We claim no ownership of them.

You give us the permission we need to run the service: to store your forms, display them publicly at the links you share, receive answers on your behalf, and return them to you. That permission lasts as long as you keep the content with us and ends when you delete it.

You are responsible for what your forms ask and what you do with the replies, including having a lawful basis to collect them and giving your respondents whatever notice the law requires.

5. What you may not collect

Formset is a general-purpose form service and is not built for regulated data. Do not use it to collect:

  • payment card numbers, security codes, or bank credentials;
  • passwords or access codes for any other service;
  • protected health information subject to HIPAA or equivalent rules;
  • government identity numbers, unless you have a legal basis and have told us in advance;
  • anything covered by a regime we have not agreed in writing to support.

If you collect it anyway, that is your risk, and we may remove the form.

6. Acceptable use

Do not use Formset to:

  • impersonate a person, company, or public body, or build a form that pretends to be someone else's sign-in page;
  • phish for credentials or trick people into revealing information about themselves;
  • send or promote spam, or publish links to a form to people who did not ask for it;
  • break the law, infringe someone's rights, or publish content that is unlawful, hateful, or sexually exploitative;
  • distribute malware, or probe, scan, or overload our systems;
  • work around plan limits, rate limits, or the access controls on other people's data;
  • resell the service as your own without our written agreement.

Every hosted form can be reported. We look at reports and remove forms that break these rules.

7. Your respondents

People who fill in your form are your audience, not our users. You decide what to ask, you tell them who you are and why, and you answer their questions about their own data. We keep their answers for you and hand them to nobody else.

Where data protection law applies, you are the controller of those answers and we act as your processor under this agreement.

8. Plans and payment

The free plan has limits on active forms, answers per month, and how long answers are kept. The current limits are on our pricing section, and we will tell you before we reduce them.

A paid plan costs [YOUR PRICE] per month, billed in advance through [PAYMENT PROCESSOR] and renewing until you cancel. Cancel any time; your plan runs to the end of the period you paid for. Fees already paid are not refundable except where the law says otherwise. Taxes are yours unless we state otherwise. If a payment fails, we may move your account to the free plan, which can mean answers past the free retention window are deleted.

9. Availability and changes to the service

We aim to keep Formset running and your forms reachable, but we do not promise uninterrupted service. We deploy, patch, and occasionally break things. We may change or withdraw features, and if we withdraw something you rely on, we will give you reasonable notice and a way to export your data.

10. Suspension and closing your account

You can close your account at any time by asking in your assistant or writing to [SUPPORT EMAIL]. We delete your forms and answers when you do.

We may suspend or close an account that breaks these terms, exposes us or our users to legal risk, or is being used to harm people. Where we can, we tell you first and give you a chance to fix it. For serious abuse we act immediately.

11. Our intellectual property

Formset, its software, its name, and its logo are ours. These terms give you the right to use the service, not to copy it, resell it, or use our branding without permission.

If you send us feedback, we may use it to improve Formset without owing you anything for it.

12. No warranty

Formset is provided as it is. To the fullest extent the law allows, we make no warranties, express or implied, including any implied warranty of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that the service will be uninterrupted, error-free, or that your data will never be lost. Keep your own copies of anything you cannot afford to lose.

13. Limits on liability

To the fullest extent the law allows, neither party is liable for indirect, incidental, special, or consequential damages, or for lost profits, lost revenue, or lost data. Our total liability for any claim arising out of this agreement is limited to the greater of the fees you paid us in the twelve months before the claim, or one hundred [CURRENCY].

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by negligence, or for fraud. If you are a consumer, your statutory rights are unaffected.

14. Indemnity

You will defend and indemnify us against claims, damages, and reasonable costs arising from the forms you publish, the data you collect, or your breach of these terms. We will tell you promptly about any such claim and let you control the defence, so long as any settlement releases us fully.

15. Changes to these terms

We may update these terms. For a change that materially affects you, we will email account holders at least 30 days before it takes effect. If you keep using Formset after that, the new terms apply; if you would rather not accept them, close your account and we will refund any unused prepaid fees.

16. Law and disputes

These terms are governed by the laws of [GOVERNING LAW], and the courts of [VENUE] have exclusive jurisdiction, except that either of us may seek an injunction anywhere to protect intellectual property. If you are a consumer, you keep the protection of the mandatory laws of the country you live in.

If a court finds any part of these terms unenforceable, the rest stays in force. Our not enforcing something once does not waive it. You may not transfer this agreement without our consent; we may transfer it to a successor of the business.
